Himachal Government To Constitute Real Estate Regulatory Authority

htwHimachal Pradesh will constitute Real Estate Regulatory Authority to control real estate sector in the state. The authority will be constituted under the real estate act passed by union government. In fact the state government has started the exercise to enact this law in the state. Town and Country Planning Department has started preparing the draft rules of this act. Once constituted, the authority will help in tightening noose on real estate sector and to break the monopoly of real estate businessmen. Notably, the union government has passed this act last year. Under the act, it is mandatory for all states to constitute Real Estate Regulatory Authority (RERA) and to draft rules for implementation of the act. Himachal has charted out the draft rules in this regard and the rules will be implemented after the approval from the state government paving way for implementation of real estate act. According to rules, now Real Estate Regulatory Authority will keep a check on the working of real sector. The state government will appoint the members and chairperson of the authority. The authority will have information of all the projects. Besides, residential projects, Real Estate Regulatory Authority will also regulate the commercial projects. The authority will solve all the disputes related to flats purchasing and will be granted all the powers to take action against the violators. However, for that government will have to constitute appellate authority too. The website of regulatory authority will contain all the information of projects of real estate businessmen, layouts, government’s approval, project estimate and time for completion.

Registration Mandatory At RERA

Untill now, there was no effect on real estate businessmen in case of delay of projects. But, after the constitution of Real Estate Regulatory Authority, they will have to compensate for it. The registration of all the projects that are spread over more than 500 square metres or bigger than eight apartments will be mandatory at Real Estate Regulatory Authority. The authority will protect the interests of consumers after coming into existence.
